TERMS AND CONDITIONS

PAYMENT TERMS 

Orders for client materials will be placed upon receipt of 50% of total sale, including tax and shipping. The remaining balance will be due 14 days prior to shipment of the order.

DELIVERY

We currently deliver to the greater Dallas-Fort Worth area as well as many parts of Southern California. Delivery is curbside only. It is the Customer’s responsibility to provide any necessary labor and/or equipment to transfer shipment from curbside to job site, and an authorized representative to check materials for damage, quantity and quality. Quantities should be cross-checked against the packing list sent with the shipment. Any suspected damage that shows to the stone product or crates during unloading should be noted on the trucker’s delivery receipt. If damage is found following completion of the delivery, photographic evidence of the damage is required. Any claims should be made initially by phone to Customer Service at (972)427-4330 and then must be submitted in writing, including photographs of the damage, by email to hello@bellebloo.com, within three (3) days of delivery. 

Note: Material should be installed by mixing all crates and boxes to ensure blending of any shade variation; please ensure the product is thoroughly dry when assessing for shade/color. No claims can be made once the material is installed. 

QUANTITIES ORDERED

An installer, contractor, or other qualified people, must check all quantities on the invoice. Although we may have assisted in the preparation of quantities and sizes on the order/invoice we will not be held responsible for any discrepancies. 

INSTALLATION

Belle Bloo LLC does not accept any responsibility or liability for the installation, sealing, or refinishing of any product. 

RETURNS AND CANCELLATIONS

We import all customer orders directly from Belgium. Each order is custom fabricated for our clients. Once the balance is paid no returns or cancellations will be accepted. In the case of a product arriving damaged, please see Delivery Terms above.

DISCLAIMER OF IMPLIED WARRANTIES

There are no warranties that extend beyond the description of the face hereof. Belle Bloo LLC disclaims any implied warranty of merchantability and fitness for a particular purpose. 

DISCLAIMER OF EXPRESS WARRANTIES

There are no express warranties other than as set forth on the face hereof. Belle Bloo LLC disclaims any other express warranties as to the goods and to a fitness for a particular purpose. 

DISCLAIMER OF RELIANCE UPON REPRESENTATIONS

Client acknowledges that he/she is not relying on any oral representations of any representative of Belle Bloo LLC. 

LIMITED ONE-YEAR WARRANTY

The stones are warranted to the original purchaser for one year from the date of installation. Belle Bloo LLC will at its election repair or replace product or make appropriate adjustments, where our inspection shows any defects not consistent with the material occurring in normal usage within one year after the installation. Damage to the product caused by inappropriate installation, accident, misuse, abuse, or improper maintenance or sealing is not covered by this warranty. Variations of color, shade, grain, veining, and texture are not defects. No warranties are made against dirt, scratching, or wear due to improper installation, improper sealing, or grouting, falling objects, abuse, misuse, exposure to extreme temperatures, use of improper chemicals or compounds, non-foot traffic wear. Where replacement is indicated Belle Bloo LLC is not responsible for any direct or indirect costs including removal and installation. 

LIMITATIONS ON DAMAGES

Belle Bloo LLC shall not under any circumstances be liable for any incidental consequential or special damages (including, without limitation, loss for delay, removal, reinstallation) arising directly or indirectly from the sale or use of goods sold. 

GOVERNING LAW

This Contract is governed by the State of Texas, and the contract shall be deemed to be principally an agreement for the sale of goods rather than services, and the Uniform Commercial Code is to apply to the fullest extent permitted under Law. Disputes under this agreement will be decided in a federal or state court of competent jurisdiction.
